What is Agency?
Agency is the ability to act. Each person has agency in their own lives, which includes: making decisions, taking action, and accepting responsibility for the consequences of their actions.
What is an Agency Relationship?
An Agency Relationship is a relationship of trust, in which one person (the Principal) gives a representative (the Agent) authority to act on the Principal's behalf. In business, this is referred to as a "Fiduciary Relationship", coming from the Latin word for "faith".
What are the Agency Requirements?
The following three things are required in an agency relationship. You can remember them as the ABC's:
- Agreement. There must be agreement between the Principal and Agent.
- Benefit. The Principal benefits from the services of the Agent
- Control. The Agent may not simply do whatever they want to do when representing the Principal. The Principal has final say or "control" of the agent's actions on their behalf.
Who is a Client?
A more common word for "Principal" in an agency relationship is "Client". A client is represented by their Realtor.
Who is a Customer?
A customer may benefit from the services of a Realtor, but there is no fiduciary relationship. A customer is party to a real estate transaction (buyer or seller) but is not represented by a Realtor.
Does an agency relationship have to be in writing?
- An agency relationship does NOT have to be in writing. It can be implied through action. For instance, if a licensee gives a consumer recommendations on pricing, this action may be imply an agency relationship.
- To avoid confusion (and possible lawsuits), an agency relationship SHOULD be in writing for everyone's protection.

State of Hawaii License Exam Prep
DESCRIPTION: Learn everything you need to know to pass the Hawaii State Portion. NOTE: The Hawaii Exam for Licensure includes both a "State Portion," specific to Hawaii, and "National Portion". General Real Estate Principles for the National Portion are not covered in this course.
WHO IS THIS FOR: Persons preparing for the Hawaii Licensure Exam who are already licensed in another state (and exempt from HI educational requirements) OR anyone who wants to learn Real Estate laws, principles and practices specific to Hawaii.
WHAT YOU WILL LEARN: Topics in this course include: Fee Simple vs. Leasehold Property Ownership, Lien Theory vs. Title Theory, Recording Systems in Hawaii, Dower Rights, and Native Hawaiian Land rights.
WHAT YOU WILL GAIN: A greater appreciation for the uniqueness of land in Hawaii and knowledge to pass the Hawaii portion of the exam.
